1. Introduction

4.10 Refund and Chargeback Abuse

        Submitting refund requests based on false, misleading, or pretextual grounds.

        Initiating chargebacks without first attempting to resolve issues directly with the Company.

        Engaging in patterns of repeated refund requests followed by repurchase or continued access.

        Initiating chargebacks after substantial use, consumption, or download of Digital Products without valid grounds.

        Using chargebacks as a method of obtaining free access to Digital Products.

        Misrepresenting the facts of a transaction in disputes with payment processors or financial institutions.

4.11 Unauthorized Commercial Use

        Using the Services or Digital Products for any commercial purpose without express written authorization.

5. User-Generated Content Standards

If the Services permit the submission of User-Generated Content, including reviews, comments, ratings, or feedback, such content must comply with the following standards. The Company reserves the right to monitor, review, edit, remove, or refuse User-Generated Content at its sole discretion.

5.1 Permitted User-Generated Content

        Honest, accurate, and good-faith reviews and ratings of Digital Products.

        Constructive comments and feedback regarding the Services.

        Legitimate inquiries and customer support requests.

        Lawful expression of opinions, provided they do not violate this Policy or any third-party rights.

5.2 Restrictions on User-Generated Content

        Must not violate any applicable law or regulation.

        Must not infringe upon any intellectual property, privacy, publicity, or other rights of any third party.

        Must not contain false, misleading, defamatory, or fraudulent statements.

        Must not contain personal information of third parties without consent.

        Must not promote, endorse, or facilitate prohibited activities.

        Must not include malware, malicious links, or other harmful elements.

        Must not violate any standards of decency, civility, or respect.

5.3 License Granted to the Company

By submitting User-Generated Content, you grant Storifayo LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works of such content in connection with the Services and the Company's business operations.

5.4 Representation and Warranty

By submitting User-Generated Content, you represent and warrant that:

        You own or have the necessary rights and permissions to submit the content.

        The content does not violate this Policy or any applicable law.

        The content does not infringe upon any third-party rights.

        All factual statements contained in the content are accurate and not misleading.

 

6. Security and Verification Cooperation

Users are required to cooperate with security, verification, and compliance procedures established by the Company and its third-party providers. Specifically, Users agree to:

        Respond to identity verification requests when reasonably required.

        Provide truthful information for fraud screening and risk assessment.

        Participate in 3D Secure or Strong Customer Authentication procedures when triggered by payment processors.

        Disclose any known security incidents affecting their Account or payment information.

        Comply with reasonable requests for documentation, including proof of identity, address, or source of funds, in connection with high-value or high-risk transactions.

Failure to cooperate with security or verification procedures may result in Order cancellation, Account suspension, or other enforcement actions.

 

7. Reporting Violations

Enforcement decisions are made at the Company's sole discretion. The Company is not required to provide advance notice before taking action, particularly in cases involving significant harm, illegality, or risk to the Services or other parties.

 

9. Appeal Process

If you believe that an enforcement action was taken in error, you may submit an appeal by contacting contact@projectvilgatekaivenmorrick.com with the following information:

        Your name and Account information.

        Description of the enforcement action.

        Detailed explanation of why you believe the action was taken in error.

        Any supporting evidence or documentation.

Appeals are reviewed by a senior member of the customer support or compliance team. The Company aims to provide a response within fifteen (15) business days. Appeal decisions are final, except where additional review is required by applicable law.

Submission of an appeal does not automatically suspend or reverse the enforcement action. The Company may continue to enforce its decision while the appeal is being reviewed.

 

10. Cooperation with Law Enforcement

However, where third-party conduct affects the Services or its Users, the Company may take reasonable steps to mitigate harm and enforce its rights, including:

        Removing third-party content or links from the Services.

        Suspending integrations with third-party services.

        Working with affected third parties to resolve issues.

        Pursuing legal remedies where appropriate.

 

12. Limitation of Liability

        Your violation of this Policy.

        Your User-Generated Content.

        Your interactions with other Users or third parties.

        Your misuse of the Services or Digital Products.

        Any unlawful, fraudulent, or harmful conduct attributable to you.

 

14. No Waiver

The Company's decision not to enforce any provision of this Policy in a particular case does not constitute a waiver of the Company's right to enforce that or any other provision in the future. Failure to act on a violation does not imply approval, acceptance, or licensing of that conduct.

 

15. Changes to This Policy

The Company reserves the right to modify this Policy at any time, in its sole discretion, to reflect changes in our practices, applicable law, or operational needs. When changes are made, we will:
